LIMITED WARRANTY ON TORUS PRODUCTS

THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE. 

THE LIMITED WARRANTY CAN ALSO BE FOUND ONLINE AT WWW.TORUS .CO/WARRANTY-RESI AND IN THE DOCUMENTATION WE PROVIDE WITH THE PRODUCT.

WE WARRANT THAT DURING THE WARRANTY PERIOD, THE PRODUCT WILL BE FREE FROM DEFECTS IN MATERIALS AND WORKMANSHIP AND WILL CONFORM TO THE SPECIFICATIONS IN THE APPLICABLE PURCHASE ORDER.

WE LIMIT THE DURATION AND REMEDIES OF ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE TO THE DURATION OF THIS EXPRESS LIMITED WARRANTY, SUBJECT TO ANY STATE-SPECIFIC LIMITATIONS THAT MAY APPLY. 

OUR RESPONSIBILITY FOR DEFECTIVE GOODS IS LIMITED TO REPAIR OR REPLACEMENT AS DESCRIBED BELOW IN THIS WARRANTY STATEMENT. 

WHO MAY USE THIS WARRANTY?

Torus Hardware LLC, located at address 855 West 2400 South, South Salt Lake, Utah 84119 (“Torus” or “we”), extends this limited warranty to the owner who originally purchased the product and any subsequent owner or other transferee of the product so long as all subsequent owners or other transferees adhere to the conditions of the warranty.

WHAT DOES THIS WARRANTY COVER?

This limited warranty covers labor and defects in materials and workmanship of the products sold and installed by Torus or by a Torus certified installer (the “product”) for the Warranty Period as defined below.

WHAT DOES THIS WARRANTY NOT COVER?

This limited warranty does not cover any damage due to: (a) transportation; (b) storage; (c) improper use; (d) failure to follow the product instructions or to perform any preventive maintenance; (e) failure to maintain connectivity to the internet such that we cannot properly monitor the function of the product; (f) failure to update firmware in accordance with our firmware release schedule; (g) repair or modifications performed by any party other than Torus or our certified representative; (h) unauthorized repair; (i) normal wear and tear; or (j) external causes such as accidents, abuse, or other actions or events beyond our reasonable control.

WHAT IS THE PERIOD OF COVERAGE?

This limited warranty starts on the date that installation is complete and lasts for one year (the “Warranty Period”). The Warranty Period is not extended if we repair or replace the product. We may change the availability of this limited warranty at our discretion, but any changes will not be retroactive.

WHAT ARE YOUR REMEDIES UNDER THIS WARRANTY?

With respect to any defective product during the Warranty Period, we will, in our sole discretion, repair or replace such product (or the defective part) free of charge. We will also pay for shipping and handling fees to return the repaired or replacement product to you.

PARTS ONLY WARRANTY

In addition to the warranty described above, certain products or components are eligible for a parts only warranty, subject to applicable third party warranty documentation provided with the product. You are responsible for shipping, handling, and labor costs after the first year. Labor performed by any party other than a Torus or a certified Torus provider shall void this warranty.

  • Ten (10) year warranty for lithium-iron batteries, subject to degradation of no more than 30% of initial capacity or 7,500 cycles, whichever comes first.
  • Five (5) year warranty for Nova Pulse inverter

HOW DO YOU OBTAIN WARRANTY SERVICE?

To obtain warranty service, you must email our Customer Service Department at warranty@torus.co during the Warranty Period, to obtain a Defective Merchandise Authorization ("DMA") number. No warranty service will be provided without a DMA number.

LIMITATION OF LIABILITY

THE REMEDIES DESCRIBED ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND OUR ENTIRE LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY. OUR LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE PRODUCT, NOR SHALL WE UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT.

SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
